By accessing or using Facility Hub's computerized maintenance management system (CMMS) and related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Facility Hub provides a cloud-based CMMS platform that enables organizations to manage facility maintenance, track assets, create and manage work orders, schedule preventive maintenance, and manage vendor relationships. The service is provided "as is" and may be updated, modified, or discontinued at our discretion.

3. Account Registration

To use certain features of our service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. User Responsibilities

When using our services, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the service for any illegal or unauthorized purpose
  • Interfere with or disrupt the service or servers
  • Reverse engineer, decompile, or disassemble any part of our service
  • Share your account credentials with unauthorized parties

5. Data Ownership and Rights

You retain all rights to the data you input into Facility Hub. By using our service, you grant us a limited license to use, process, and store your data solely to provide and improve our services. We will not sell, share, or use your data for purposes other than providing the service unless required by law.

6. Intellectual Property

The Facility Hub service, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service without our prior written consent.

7. Payment Terms

If you subscribe to a paid plan:

  • You agree to pay all fees associated with your subscription plan
  • Fees are billed in advance on a recurring basis (monthly or annually)
  • All payments are non-refundable unless otherwise stated
  • We reserve the right to change pricing with reasonable notice
  • Failure to pay may result in suspension or termination of your account

8. Service Availability

We strive to maintain high availability of our service but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or experience unforeseen outages. We will make reasonable efforts to notify users of planned downtime in advance.

9. Limitation of Liability

To the maximum extent permitted by law, Facility Hub and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or uninterrupted.

11. Indemnification

You agree to indemnify, defend, and hold harmless Facility Hub and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service or violation of these terms.

12. Termination

We may suspend or terminate your access to the service at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease. You may also terminate your account at any time by contacting us. Provisions that by their nature should survive termination will remain in effect.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Facility Hub operates, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of the service after changes become effective constitutes acceptance of the new terms.
